Elder Law

The Firm can help anyone concerned about a senior citizen in New York or New Jersey. We help you find the right care for your loved one without losing all of your money to a nursing home. We provide peace of mind and security and show people how to save tens of thousands of dollars – or more – with the proper planning. Our job as elder law attorneys is to make sure you and your loved ones will be protected when you or they can no longer take care of themselves. Elder law includes estate and tax planning, nursing home asset protection, planning for incapacity, Medicaid planning, Veterans’ Benefits, long-term care insurance issues and other health care matters and planning.

Probate/Estate Administration

There is much written about the estate settlement process and probate. The reality is that much of the information given to consumers is misleading or simply false. The fact is that your experience with what happens when a loved one dies has more to do with the lawyer you hire to help you than any other factor. Choose the wrong lawyer and your experience will be a time-consuming, expensive nightmare. The attorneys and staff at the Law Firm of Greco & Scotto, PC take great pride in simplifying the estate settlement and probate process so that you can relax knowing things are being handled properly. By simplifying the process, we can also save you time and money. The Firm assists with all aspects of estate and trust settlement and probate.

Wills and Trusts

We cannot over-emphasize the importance of early estate planning. People of all ages need to have certain basic tools in place. Estate planning includes wills, trusts, durable powers of attorney, living wills and health care powers of attorney, and coordinating property ownership and beneficiary designations with the overall plan. Because we are both estate planning and elder law attorneys, we offer more protection for our clients that most estate planning lawyers don’t consider.

Residential Real Estate Transactions

Buying or selling a house is one of the most important transactions you may make in your lifetime. Unfortunately, unforeseen legal issues often arise. When such matters surface, the assistance of Greco & Scotto, PC can be invaluable in helping you find the resolutions you need to move your transaction forward. With our knowledge of the real estate process, we will help you through the process as quickly and painlessly as possible. Whether you are considering purchasing your first home, upgrading or downsizing, we can help you to handle your real estate transaction as quickly and effectively as possible. The firm is especially adept at handling simultaneous purchases and sales for clients relocating from New York to New Jersey

Commercial Real Estate Transactions

The purchase or sale of a property is often one of the most important financial decisions in a person’s lifetime.  The transfer of a building  often triggers serious financial and tax concerns.  The law firm of Greco & Scotto, PC assures that our clients receive prompt and professional service in these important transactions and guides our clients in protecting their interests.  We assist our clients with all aspects of their transaction, including obtaining commercial financing, selling, leasing, or purchasing real property, purchasing new construction, drafting and reviewing real estate contracts and drafting and negotiating Commercial Leases.

Tax Appeals

All New Jersey property owners have the ability to appeal New Jersey real estate tax assessments every year.  Seeking the services of Greco & Scotto, PC is advisable in a situation where you are considering challenging your real estate taxes.  We will help clarify and streamline the process.

IRS Litigation

If you are audited and you believe that the assistance of a professional is needed, you should keep in mind that there are only three types of professionals that can represent you before the IRS, Attorneys, Certified Public Accountants and Enrolled Agents. When you engage our firm to handle an IRS audit, you may feel comfortable that our fees are reasonable and you will have an upfront idea of what the fee will be. We also advise you whether or not it is financially responsible for you to engage our firm. We have seen many clients engage other firms and spend thousands of dollars in fees where a tax liability was much less than what they paid their representative. When we are engaged to provide tax litigation services, we use our vast experience and our team meets to evaluate and assess the situation.

Estate/Inheritance Taxes

New Jersey has many different types of taxes, including two different taxes on death: the NJ Estate Tax and the NJ Inheritance Tax. The New Jersey estate tax is a tax on transfers at death and certain transfers in contemplation of death. New York also has an estate tax and the rules and intricacies are very complex.
